Terms of Service

By accessing or using The Red Flag Club ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.

You must be at least 18 years old to use The Red Flag Club. By creating an account, you represent and warrant that you are 18 or older. We reserve the right to terminate accounts of users who misrepresent their age.

The Service is currently available globally but is primarily designed for users in India. Where local law prohibits use of AI companion services, you must not use the Service.

The characters on The Red Flag Club (Myarah, Rhea, Fiza, Shreya, and any future characters) are fictional AI personas. They are not real people. Any resemblance to real individuals is coincidental. Conversations with these characters are generated by artificial intelligence and do not represent the views, feelings, or intentions of any real person.

The Service is intended for entertainment, companionship simulation, and creative engagement. It is not a substitute for real human relationships, mental health support, or professional advice of any kind. If you are experiencing a mental health crisis, please contact a qualified professional or a crisis helpline.

AI responses may occasionally be inaccurate, inconsistent, or unexpected. We do not guarantee the accuracy of any information provided by the AI characters.

You may register using the sign-in options we make available. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately at support@theredflag.club if you suspect unauthorised access.

You may only create one account per person. Creating multiple accounts to circumvent usage limits or other restrictions is prohibited.

Free tier

The Service offers a limited free trial as set by us from time to time. Trial limits may change without notice.

Premium plans

Paid plans unlock a set number of messages (in packs), photo sharing, voice notes, memory, and other features, as displayed at checkout. All payments are handled securely through our authorised third-party payment partner. Fees are charged in Indian Rupees (INR) as displayed at checkout.

No refunds. All sales are final

All payments made to The Red Flag Club are final and non-refundable. By completing a payment, you acknowledge and agree that you are purchasing access to a digital service and that no refund will be issued under any circumstances, including but not limited to:

• Change of mind after purchase.
• Failure to use the Service during the subscription period.
• Dissatisfaction with AI-generated content.
• Account suspension or termination due to violation of these Terms.
• Technical issues on your own device or internet connection.

This no-refund policy is consistent with the nature of digital content services and is permitted under applicable Indian consumer protection regulations for digital goods.

No cancellations

Subscriptions are non-cancellable once payment has been made. Your access remains active until the end of the paid period. We do not offer mid-period cancellations, partial refunds, or pro-rated credits.

Chargebacks

Initiating a chargeback or payment dispute with your bank or card issuer for a valid purchase constitutes a breach of these Terms. We reserve the right to permanently ban accounts associated with fraudulent chargebacks and to pursue recovery through lawful means.

You agree not to:

• Use the Service if you are under 18 years old.
• Attempt to access, extract, reverse-engineer, or circumvent the Service's underlying models, instructions, configuration, or logic.
• Use automated scripts, bots, or other tools to interact with the Service at scale.
• Attempt to make the Service produce content involving minors in any sexual or harmful context.
• Use the Service to harass, threaten, or harm other people.
• Reverse-engineer, scrape, copy, mirror, or replicate the Service, its characters, content, design, or underlying technology.
• Share access to your account with others or resell access.
• Attempt to probe or exploit security vulnerabilities in the Service.
• Impersonate another person or entity.
• Use the Service for any unlawful purpose.

We reserve the right to suspend or terminate your account immediately and without refund if you violate these terms.

The Service and every element of it — including its characters, names, personalities, dialogue, artwork, copy, visual design, look and feel, software, and underlying technology — is the exclusive property of The Red Flag Club and is protected by intellectual property and unfair-competition laws. All rights are reserved. You may not copy, reproduce, re-derive, distribute, publicly display, scrape, frame, mirror, or create derivative or competing works from any part of the Service, in whole or in part, without our prior written permission. Nothing in these terms grants you any ownership of, or licence in, our brand or content beyond the limited right to use the Service for your personal, non-commercial enjoyment.

You retain ownership of the original messages you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, and process that content as necessary to operate, secure, and provide the Service to you.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these terms by reference.

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.

To the maximum extent permitted by applicable law, The Red Flag Club and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not responsible for any emotional distress, addiction, or harm arising from use of AI companion features. Please use the Service responsibly.

You may delete your account at any time from within the app. We may suspend or terminate your account at any time for violation of these terms, suspected fraud, or at our discretion with or without notice.

Upon termination, your right to use the Service ceases immediately. Provisions of these terms that by their nature should survive (intellectual property, disclaimers, limitation of liability) will survive termination.

These terms are governed by the laws of India. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Before initiating any formal dispute, you agree to first contact us at support@theredflag.club and give us 30 days to resolve the matter informally.
